ENTIRE AGREEMENT: This agreement contains the entire understanding between THE PHOTOGRAPHER and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all parties. In the event that any part of this agreement is found to be invalid or unenforceable, the remainder of this agreement shall remain valid and enforceable. Any agreement to waive one or more provisions of this agreement or any failure by one or both parties to enforce a provision of this agreement shall not constitute a waiver of any other portion or provision of this agreement.
RESERVATION: A signed contract and retainer fee of €200 is required to reserve the dates and times of the EVENT(S). If the EVENT(S) are rescheduled, postponed, or cancelled; or if there is a breach of contract by the CLIENT, the retainer fee is non-refundable and shall be liquidated damages to THE PHOTOGRAPHER. The CLIENT shall also be responsible for payment for any of the COMPANY’s materials charges incurred up to time of cancellation.
CLIENT GALLERY: THE PHOTOGRAPHER does not hold responsibility for any damage or loss to CLIENTS photos using any 3rd party software. Client Gallery will expire after 3 Months. The CLIENT can opt in for having their photos stored on this gallery for €9.99 per month.
The CLIENT will be the owner of the gallery, they will be able to download every photo and slideshow (if provided) These will be accessible in web-format and high resolution format. There is no cost for the owner The CLIENT to download photos.
PHOTO DELIVERY: The CLIENTS photos will be delivered by a 3rd party software ''My Pic Time'' Delivery time will vary based on how busy the PHOTOGRAPHER is. The normal wait time is anywhere from 8-12 weeks. The PHOTOGRAPHER will not deliver RAW photos in any circumstances. The CLIENT is responsible for downloading and archiving the photos in case the hosting company decides to remove them or ceases operations. Candid Dreamers will make reasonable efforts to provide the photos if you fail to download them, but cannot guarantee their availability. All RAW Photos will be deleted from the Photographers hardware 1 year after delivery.
CAPTURE AND DELIVERY: THE PHOTOGRAPHER is not liable to deliver every image taken at the event. The determination of images delivered to the CLIENT is left to the discretion of THE PHOTOGRAPHER. Editing will not commence until all outstanding charges have been paid in full. If, for any reason, you are unhappy with any aspect of the wedding photo package upon receipt, you agree to immediately contact THE PHOTOGRAPHER in writing, detailing the issue. This must be done within 14 days of receiving the wedding photo package. Failure to do so may result in the removal of the photos from THE PHOTOGRAPHER systems. Extra editing may incur additional charges, which will be determined at the discretion of THE PHOTOGRAPHER If there is an issue with the photos that is the fault of THE PHOTOGRAPHER and can be rectified, THE PHOTOGRAPHER agrees to rectify the error and provide new copies to you without charge.
STORAGE: The PHOTOGRAPHER will take every precaution storing and backing up the CLIENTS photos. However, in the unlikely event of data damage, loss or damage to hard drives, laptops or computers - THE PHOTOGRAPHER will not be held liable.
POST PRODUCTION AND EDITING: The final post production and editing styles, effects, and overall look of the images are left to the discretion of THE PHOTOGRAPHER
POST PRODUCTION AND EDITING (Revisions): The PHOTOGRAPHER will grant 2 hours of free edits, retouches and gallery arrangements. (After the gallery is delivered, if the CLIENT is unhappy with certain photos) Thereafter it will be at a set hourly rate of €40.
EVENT SCHEDULE: The client agrees to confirm the schedule one-week prior to the EVENT(S). Notification of any changes in schedule or location must be made in a timely manner and confirmation of receipt must be obtained from THE PHOTOGRAPHER by the CLIENT.
SAFETY: THE PHOTOGRAPHER reserves the right to terminate coverage and leave the location of the EVENT(S) if THE PHOTOGRAPHER experiences inappropriate, threatening, hostile or offensive behaviour from person(s) at the EVENT(S); or in the event that the safety of THE PHOTOGRAPHER is in question.
SHOOTING TIME / ADDITIONS: The CLIENT and THE PHOTOGRAPHER agree that cooperation and punctuality are essential to accomplish the goals and wishes of all parties. Shooting commences at the scheduled start time and ends at the scheduled end time. If the CLIENT does not arrive at the appointed time for the EVENT(S), shooting will commence at the scheduled start time and end at the scheduled end time. All additional time beyond the scheduled end time will be billed to the CLIENT.
EXPENSES INCURRED: When applicable, the CLIENT is responsible for all travel, accommodation, meal and transport costs unless provided by the CLIENT.
TRAVEL EXPENSES: All travel expenses are included in prices. Unless Wedding is outside of Ireland.
RESPONSIBILITIES: THE PHOTOGRAPHER is not responsible for compromised coverage due to causes beyond the control of the THE PHOTOGRAPHER including but not limited to obtrusive guests, lateness of the CLIENT or guests, weather conditions, schedule complications, incorrect addresses provided to THE PHOTOGRAPHER rendering of decorations, or restrictions of the locations. THE PHOTOGRAPHER is not responsible for backgrounds or lighting conditions which may negatively impact or restrict the photo coverage. THE PHOTOGRAPHER is not held liable for missed coverage of any part of the EVENT(S). THE PHOTOGRAPHER will not be held accountable for failure to deliver images of any individuals or any objects at the EVENT(S).
VENUE AND LOCATION LIMITATIONS: THE PHOTOGRAPHER is limited by the rules and guidelines of the location(s) and site management. The CLIENT agrees to accept the technical results of their imposition on THE PHOTOGRAPHER Negotiation with the officials for moderation of guidelines is the CLIENT’s responsibility; THE PHOTOGRAPHER will offer technical recommendations only.
PERMITS: The CLIENT is responsible for acquiring all permits and necessary permission for all locations on which THE PHOTOGRAPHER will be performing services.
FILM and COPYRIGHTS: The photographs produced by THE PHOTOGRAPHER are protected by The Irish Visual Artists Rights Organisation (IVARO) (all rights reserved) and may not be reproduced in any manner without THE PHOTOGRAPHER explicitly written permission. If the CLIENT has purchased an “Image DVD” from THE PHOTOGRAPHER, upon final payment by the CLIENT, limited copyright ownership of the resulting images will be transferred to the CLIENT. If the CLIENT has purchased an “Image DVD” from THE PHOTOGRAPHER, THE PHOTOGRAPHER grants the CLIENT permission to share the images on social networking websites, with family and friends, and on vendor websites as long as the images remain unaltered and textual credit is explicitly given to THE PHOTOGRAPHER. The CLIENT must obtain written permission from THE PHOTOGRAPHER prior to publishing or selling the photographs.
CANCELLATIONS: If the EVENTS as specified above, within 1 (one) month prior to the agreed date are cancelled the CLIENT agrees to pay the remaining balance due.
RESCHEDULING: If the CLIENT needs to reschedule the agreed date of shoot prior to 6 months notice, no fee will be collected. If the CLIENT reschedules within 6 months of the agreed date of shoot, a fee of 50% of the balance due. The PHOTOGRAPHER will not be liable to refund any payments made if the newly requested date is unavailable.
MODEL RELEASE: The CLIENT hereby assigns THE PHOTOGRAPHER the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the CLIENT may be included, for editorial, trade, advertising, educational and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same without restriction. The CLIENT releases all claim to profits that may arise from use of images. To remove this right, the CLIENT will be required to pay a fee for '' loss of opportunity '' This is fee is 40% of the package overall price.
MORNING PREP: THE PHOTOGRAPHER will only cover Bride and Groom locations if they are located less than 30minutes apart.
LIMIT OF LIABILITY: In the unlikely event that THE PHOTOGRAPHER is unable to perform to the guidelines of this contract due to an injury, illness, act of God, act of terrorism, or other cause beyond the control of THE PHOTOGRAPHER will make every effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the EVENT(S). In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond THE PHOTOGRAPHER control, including but not limited to camera, hard drive, or equipment malfunction, THE PHOTOGRAPHER liability is limited to the return of all payments received for the EVENT(S). The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. THE PHOTOGRAPHER is not liable for the loss of images beyond the lesser of the final delivery of all products included in the package or one year.
PAYMENT SCHEDULE: The non-refundable retainer fee of €200 is due at the time of signing of agreement. The remaining balance is payable in full prior to or the day of the EVENT(S). In the event the CLIENT fails to remit payment as specified, THE PHOTOGRAPHER shall have the right to immediately terminate this agreement with no further obligation, retain any monies already paid, and not attend the EVENT(S).
DRONE COVER: THE PHOTOGRAPHER will not carry out Drone cover if there is Drone Resections in place at the venue or the Airspace set out by the IAA. Drone will not be used if the weather is not suitable (strong winds and rain) It is non-refundable.
WEDDING ALBUMS: THE PHOTOGRAPHER is not responsible if the Wedding Albums are damaged during delivery, The CLIENT accepts that their Wedding Albums are produced by a third party (pic-time) and falls within the terms and conditions set out by the provider.
LATE FIRST DANCE: If the first dance does not start before 1030 pm The Client accepts there is an additional fee of €170 for extra time.
SPONTANEOUS OCCURRENCES: THE PHOTOGRAPHER is not responsible if speeches, toasts, or other events happen spontaneously outside of the agreed-upon times and are subsequently not captured.
LOCATIONS & TRAFFIC THE PHOTOGRAPHER is not responsible if incorrect Eircodes are given. Directions are not sufficient. If the PHOTOGRAPHER is delayed due to road works, traffic or other road traffic related issues, the PHOTOGRAPHER will not be held liable for missed coverage.
The Client must provide Eircodes to all locations.
CANDID STYLE PHOTOGRAPHY
Candid-style wedding photography is a specialized approach to photography that is characterized by capturing unposed, spontaneous, and genuine moments during the wedding event. This style prioritises the documentation of authentic emotions, interactions, and reactions of the subjects involved.
Objective The primary objective of candid-style wedding photography is to create a visual narrative of the wedding day that accurately reflects the real and unscripted moments experienced by the Client, the wedding party, and attendees.
Methodology In the pursuit of candid-style wedding photography, the Photographer will discreetly observe and document the wedding event, aiming to capture spontaneous expressions, natural interactions, and heartfelt moments. This may involve minimal intervention or direction, allowing events to unfold naturally.
Artistic License The Photographer retains artistic license in the creation and selection of candid-style photographs. While every effort will be made to fulfill the Client's preferences, the Photographer may exercise professional judgment in the composition, selection, and post-processing of images to achieve the desired artistic effect.
Client Understanding The Client acknowledges and understands the nature of candid-style wedding photography as described herein. By entering into the Agreement, the Client expresses their consent and willingness for the Photographer to employ this style in capturing images of the wedding event.
FOOD & RUBBISH
THE PHOTOGRAPHER is not responsible to edit out food, rubbish or dirt from the locations such as personal homes, venues or churches. It is the CLIENTS responsibility to have a clean home if they want do not want their photos to be jeopardised by rubbish being left out. I will clean for certain shots but will NOT clean for every shot.
MISCELLANEOUS PHOTOGRAPHY: If there are specific moments or scenes the client wishes to have photographed, they must communicate this to Candid Dreamers in writing (email will suffice) before the wedding day.
TIMES: The Dreamer max 14 hours. The Extensive max 11hours (Typical start time is 11am and will finish for 10:15 (+15minutes incl)
