WEDDING PHOTOGRAPHY AGREEMENT
ENTIRE AGREEMENT
This agreement contains the entire understanding between Candid Dreamers Ltd and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. Any additions or changes must be in writing and signed by both parties. If any part of this agreement is found invalid or unenforceable, the remainder shall remain valid. A waiver of one provision does not constitute a waiver of others.
RESERVATION
A signed contract and a non-refundable retainer fee of €150 are required to reserve the date(s) and time(s) of the EVENT(S). If the EVENT(S) are rescheduled, postponed, or cancelled, or if the CLIENT breaches the contract, the retainer remains non-refundable and serves as liquidated damages to Candid Dreamers Ltd. The CLIENT is also responsible for any materials costs incurred up to cancellation.
CLIENT GALLERY
Candid Dreamers Ltd is not responsible for damage or loss to CLIENT photos using third-party software. The gallery expires after 6 months. Continued access is available for €9.99/month. The CLIENT may download all photos and slideshows in both web and high-resolution formats at no additional cost.
PHOTO DELIVERY
Photos will be delivered via third-party software My Pic Time. Delivery usually takes 8-14 weeks, depending on workload. RAW files will not be delivered under any circumstances. The CLIENT is responsible for downloading and archiving their files. Candid Dreamers Ltd may attempt to provide backups but cannot guarantee availability after one year.
CAPTURE AND DELIVERY
Candid Dreamers Ltd is not obligated to deliver every image taken. Image selection is at Candid Dreamers Ltd's discretion. Editing will not commence until full payment is received. Complaints must be submitted in writing within 14 days of delivery. Failure to do so may result in removal of files. Additional editing is subject to a fee at Candid Dreamers Ltd's discretion. If any errors are the fault of Candid Dreamers Ltd, they will be rectified at no cost.
STORAGE
Candid Dreamers Ltd takes every precaution to store and back up CLIENT photos. However, in the event of hardware failure, damage, or loss, Candid Dreamers Ltd is not liable.
POST PRODUCTION AND EDITING
Final editing style and effects are at the discretion of Candid Dreamers Ltd. The CLIENT agrees not to apply filters or edits when posting to social media.
POST PRODUCTION AND EDITING (REVISIONS)
Candid Dreamers Ltd provides 1 hour of free revisions (retouching, gallery rearrangement). Additional editing will be charged at €150/hour.
EVENT SCHEDULE
The CLIENT must confirm the event schedule one week in advance. Changes must be communicated promptly, with confirmation of receipt.
SAFETY
Candid Dreamers Ltd reserves the right to leave the EVENT(S) if unsafe, inappropriate, threatening, or hostile conditions arise.
SHOOTING TIME / ADDITIONS
The CLIENT must be punctual. Coverage begins and ends at the agreed times. Late arrival by the CLIENT will not extend coverage. Additional time is billable.
EXPENSES INCURRED
For destination weddings, the CLIENT is responsible for travel, accommodation, meals, and transportation, unless otherwise agreed.
TRAVEL EXPENSES
All travel within Ireland is included. Travel outside Ireland incurs additional costs.
RESPONSIBILITIES
Candid Dreamers Ltd is not responsible for coverage issues due to weather, delays, obstructions, incorrect addresses, or venue restrictions. Candid Dreamers Ltd is not liable for missed shots or individuals.
VENUE LIMITATIONS
Candid Dreamers Ltd must follow all venue rules. CLIENT is responsible for negotiating any exceptions. Technical suggestions may be offered.
PERMITS
CLIENT is responsible for securing all permits and permissions for shooting locations.
PHOTO QUANTITY
Candid Dreamers Ltd does not guarantee a specific number of photos delivered. Those advertised are estimated.
COPYRIGHT
All photographs are protected under the Irish Visual Artists Rights Organisation (IVARO). CLIENTS may not reproduce, alter, or sell images without written permission. Upon final payment, limited reproduction rights are granted for personal use, provided credit is given to Candid Dreamers Ltd.
CANCELLATION
If cancelled within 3 months of the EVENT(S), the CLIENT must pay the full remaining balance.
Candid Dreamers Ltd reserves the right to cancel coverage of an EVENT(S) due to personal emergencies, family commitments, or health-related issues. In such cases, every reasonable effort will be made to secure a suitable and professional replacement photographer and/or videographer with a similar style and skillset. If no suitable replacement is available, all monies paid by the CLIENT, including the retainer, will be refunded in full. Candid Dreamers Ltd will not be held liable for any consequential damages, emotional distress, or missed opportunities resulting from such a cancellation, though the utmost professionalism and care will be taken to avoid disruption to the CLIENT’s event.
MODEL RELEASE
The CLIENT grants Candid Dreamers Ltd full rights to use images for editorial, marketing, advertising, and portfolio use. To opt out, the CLIENT must pay a 40% "loss of opportunity" fee based on the total package price.
MORNING PREP
Both partners’ preparations will only be covered if locations are less than 30 minutes apart.
LIMIT OF LIABILITY
If Candid Dreamers Ltd is unable to perform due to illness, injury, or unforeseen circumstances, a replacement will be sought. If none is found, liability is limited to a full refund. Loss of digital files is also limited to a refund of payments.
DRONE COVER
Drone coverage is weather- and regulation-dependent and is non-refundable if unavailable.
WEDDING ALBUMS
Albums are fulfilled by My Pic Time. Candid Dreamers Ltd is not liable for damages during delivery.
FIRST DANCE TIME
If the first dance occurs after 10:30 pm, an additional €250 fee applies.
SPONTANEOUS OCCURRENCES
Unscheduled events (e.g. speeches) not discussed or outside of agreed time may not be captured.
COVER TIME LIMIT
The Dreamers max 12.5hrs
The Extensive max 10hrs
The Petite max 7.5hrs
(Candid Dreamers Ltd - will finish at 1030pm even if first dance has not started - unless agreed prior to the wedding for late fees)
TIMINGS & SPEECHES
If speeches begin outside the agreed time, Candid Dreamers Ltd is not responsible for missed content.
LOCATIONS & TRAFFIC
CLIENT must provide accurate Eircodes for all locations. Candid Dreamers Ltd is not responsible for delays due to incorrect directions or traffic.
CANDID STYLE PHOTOGRAPHY
Candid Dreamers Ltd specialises in candid-style photography / documentary capturing spontaneous, unscripted moments. The CLIENT acknowledges and agrees to this artistic style. Artistic judgment is reserved by Candid Dreamers Ltd.
CLEANLINESS
Candid Dreamers Ltd is not responsible for removing clutter, rubbish, or mess from homes or venues. CLIENT is responsible for clean settings. (exceptions of important bride portraits, dress shots etc)
SPECIAL PHOTO REQUESTS
CLIENT must communicate any specific photo requests in writing (email is sufficient) prior to the wedding day.
PAYMENTS
Accepted forms: bank transfer or cash. Do not prepay the wedding balance. Early payments will incur a 5% fee.
CONTENT CREATORS
Only Candid Dreamers Ltd may place microphones during ceremonies and speeches. Content Creators may not alter timelines. CLIENT must notify Candid Dreamers Ltd if one is present. Photos may not be shared with Content Creators unless provided by Candid Dreamers Ltd.
Content Creators cannot use professional grade camera equipment.
X.1 Primary Photographer: CANDID DREAMERS Ltd will be the sole primary photographer for the wedding, responsible for capturing the full photographic story of the day with consistency and quality.
X.2 Videography: We welcome any professional videographer hired by the Couple and will work cooperatively to ensure smooth coverage while focusing on photography. (or visa versa if hired for film)
X.3 Content Creators (Restrictions): To protect the quality and flow of our work, no other individuals—including “content creators,” “influencers,” or personal photographers—may use professional-grade cameras (e.g., DSLR, mirrorless, or interchangeable lens cameras) for still photos during our contracted coverage.
X.4 Permitted Devices: Guests may take behind-the-scenes or personal content using mobile phones only, provided they do not obstruct or interfere with the professional teams.
X.5 Violation: If someone uses a professional camera without approval, we reserve the right to address it with the Couple or the individual. Continued interference may lead to a pause or halt in photography services, without liability to the Photographer.
